New York Insurance Laws
New York has no-fault laws that outline how accident victims can pursue compensation following an accident. The no-fault minimum insurance requirements, as outlined by the New York State Department of Financial Services (DFS), apply to all individual motorists.
In the event of relatively minor injuries, you may be able to recover compensation for your treatment and a portion of lost wages more quickly and seamlessly through your no-fault provider. There are limits to these awards, though. When you seek compensation in a fault-based claim, you may be able to file a lawsuit or an insurance claim to recover financial awards that include:
- Medical care and treatment expenses, both today and in the future
- Ongoing care and support costs, as necessary
- Missed paychecks and diminished earning capacity
- Additional accident-related expenses
- Pain and suffering
- Emotional distress
- Wrongful death losses, for surviving family members

Statute of Limitations on Truck Accident Cases in New York
New York law limits the time you have to file a personal injury lawsuit in response to a truck accident. In general, CPLR 214(4) applies. This statute gives most traffic accident victims three years to file a lawsuit if that becomes necessary in their case to recover an award. However, there may be other statutes that apply.
If the victim passed away as a result of their injuries, the surviving immediate family can file a wrongful death suit. Per EPTL 5-4.1, however, they only have two years to file this type of legal action.
In some cases, when the truck driver in question was behind the wheel of a garbage truck, for example, a municipality or government agency may be to blame. Under NY GMU § 50-E, you only have 90 days to notify the government about your intention to file a claim.
